Encumbrance Certificate Explained: How to Get One Online and How to Read It

Why the encumbrance certificate is the first document you should pull
If you close deals for a living, learn to pull an encumbrance certificate online before you invest a single site visit in a property. The EC is a record of registered transactions on a property for a chosen period, issued by the Sub Registrar's office. It shows sales, mortgages, gift deeds, release deeds and court attachments that were registered against the property. In plain terms, it tells you whether the seller actually has a clean right to sell, or whether a bank or a relative has a registered claim sitting on the title.
For an agent, this is commission protection. A deal that dies at the bank's legal verification stage, three weeks after you introduced the buyer, is a deal you did all the work on for free. Pulling the EC on day one costs you a small government fee and half an hour. It also positions you as the professional in the room, because most sellers have never seen their own EC.
Form 15 vs Form 16: reading what the Sub Registrar gives you
ECs come in two forms in most states. Form 15 is issued when there are registered transactions during the period you asked for, and it lists them entry by entry. Form 16 is a nil encumbrance certificate, issued when the office finds no registered transaction in that period. A Form 16 is not automatically good news. It can also mean the property was never registered in that jurisdiction, or that you searched the wrong survey number.
When you get a Form 15, read every entry, not just the latest one. Each entry typically shows the document number and year, the nature of the transaction, the parties, the schedule of the property and the consideration. Trace the chain: does each seller in an entry appear as a buyer in an earlier entry? A break in that chain is exactly what a bank's panel advocate will flag later, so find it first.
- A mortgage entry without a matching release deed entry means the loan may still be alive. Ask for the discharge proof.
- A gift deed or partition deed in the chain means more family members may need to sign the sale deed.
- An attachment or lis pendens entry means litigation. Slow down and get a lawyer's opinion before spending buyer goodwill.
- Multiple sales of the same property in a short window is a classic fraud pattern. Verify identities carefully.
How to apply for an encumbrance certificate online, state by state
Almost every large state now lets you search and apply online, though the depth of digitised records varies. In Karnataka, use Kaveri Online Services, where you can run an EC search and download digitally signed copies for many periods. In Tamil Nadu, TNREGINET issues ECs online and older records are being digitised in phases. In Andhra Pradesh and Telangana, the respective IGRS portals handle EC search and issuance. Maharashtra works differently: there is no single EC document in the same format, and agents typically rely on a search report from the Sub Registrar's index records along with the 7/12 extract from the MahaBhumi ecosystem.
Two practical warnings. First, online records usually cover only the digitised period, often from the early 2000s onwards. For a proper title search, banks commonly want 13 to 30 years of history, so you may still need a manual search at the Sub Registrar's office for older entries. Second, an EC only shows registered transactions. Unregistered agreements, oral family arrangements, unregistered leases under a year, and pending tax dues will never appear on it.
What an EC will not tell you
Treat the EC as one document in a set, never the whole story. It says nothing about sanctioned plans, building violations, occupancy status, property tax arrears or society dues. It will not reveal a power of attorney that was never registered, or a will that is being contested. If the property is agricultural land, conversion status is a separate check entirely.

A simple EC workflow for your agency
Build the EC into your intake process. When a seller lists with you, ask for their sale deed copy, note the survey number, door number and registration district, and apply for the EC covering at least the last 13 years the same week. Keep a dated copy in the deal file. When a buyer gets serious, pull a fresh EC again just before the agreement to sell, because a gap of even a few months is enough time for a seller to register a mortgage you know nothing about.
Timestamped copies also protect you professionally. If a dispute surfaces after closing, your file shows you checked the registered record at the time and disclosed what it contained. That is the difference between an agent who forwarded listings and an agent who ran a process.
